Abstract

This study  conducted to  examine the jurisprudential method of precaution, which aims to adopt the most cautious fatwas (religious rulings) to avoid falling into religious prohibitions. This is particularly important in areas where there is significant disagreement. The research looks at how adopting the most cautious approach can help preserve the five fundamental objectives of Islamic law, which are essential aims of the Sharia.


The central research problem is defining the meaning of precaution, understanding its regulations, and determining how it can be applied to maintain the five essential principles of Islamic law. The study aims to examine the concept of precaution, review the Sharia evidence supporting it, and analyze the regulations governing it. It also highlights precaution's role in protecting the five essentials through practical examples, using an inductive method to understand its relationship to these fundamental objectives.


The research concludes that precaution has legitimacy in Islamic law and is connected to other relevant concepts like the preferable opinion and blocking the means. It also finds that precaution is necessary to avoid turning it into obsessions and illusions, as this can significantly impact achieving the objectives of Sharia. Additionally, the study suggests that precaution fosters righteousness and moderation in life, contributing to a balanced and morally stable society.


The researcher recommends that conducting further extensive research on the impact of precaution on the objectives of Sharia and activating its application in contemporary jurisprudential issues related to the five essentials. This is intended to provide a comprehensive understanding of the importance of precaution and its role in enhancing the preservation of the five essentials, thereby contributing to achieving and maintaining the


objectives of Islamic law.
